Before joining our affiliate program please read the following rules and guidlines by which Windows of Nature and you the affiliate agree to operate by.

Affiliate Agreement

This agreement contains all terms and conditions that apply to you (the affiliate) as a participant in Windows of Nature Affiliate Program. "You" means the participant and "We" means Windows of Nature.

Once you have submitted an application, your site will be evaluated in good faith. Your application may be rejected if we determine that your site is unsuitable for our program.
  1. Unsuitable sites are ones that:
    • Promote sex or sexually explicit materials
    • Promote violence
    • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age
    • Promote illegal activities
    • Includes "windows-of-nature.com" or variations or misspellings in domain names.
    • Violate intellectual property rights.
  2. We will process the orders placed by customers linked to us from your site to our site. We reserve the right to reject orders that do not meet our requirements. We will be responsible for order processing, shipping and will handle all customer service requirements. We will track all sales and all sales activity reports will be made available to you.
  3. We will pay you commissions for all completed sales. This does not include sales taxes, duties, shipping or any similar charges. Amounts due to credit card fraud, bad debt and credits for returned goods are also not included. All commissions over $25.00 are paid out on a monthly basis. If a product that generated a referral fee is returned by the customer, the commission amount will be deducted from your next payment.
  4. Customers who buy products through the Affiliate program will be deemed to be customers of Windows of Nature. Accordingly all rules, policies and operating procedures will apply. We may change our policies and procedures at any time. Products and prices may vary from time to time.
  5. You will be solely responsible for the development, operation and maintenance of your site. You will ensure that materials on your site do not violate or infringe upon the rights of any third parties including copyrights, trademarks, privacy or property rights ensuring that materials posted on your site are not illegal or defamatory. We disclaim all liability from these matters. We will not be held liable for all claims, damages, and expenses relating to operation, maintenance and content of your site.
  6. The term of this agreement will begin upon our acceptance of your Affiliate agreement and will end when terminated by either party. Either you or Windows of Nature can terminate this agreement at any time with or without cause by giving written notice of termination. Upon termination you will cease use of and remove all links to our site. You are eligible to earn commissions that have occurred during the term and will remain payable only if the orders are not canceled or returned. We may hold your final payment for a reasonable time to ensure that the correct amount is paid.
  7. This Agreement does not create any partnership, joint venture, agency or franchise between you and Windows of Nature. You have no authority to make or accept any offers on our behalf.
  8. We make no representation that the operation of our site will be uninterrupted or without error and we will not be held responsible for any interruptions or errors. You will also not use our licensed material in a manner that portrays us in a negative light.
  9. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANYTIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR THAT COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN SET FORTH IN THIS AGREEMENT.

    This agreement will be governed by the laws of the United States and the state of Texas without reference to rules governing choice of laws. You may not assign this Agreement by operation of law or otherwise without our written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
